These Terms of Service (“Terms”) govern your use of heritageprops.com (the “Site”) and the text messaging program run by Heritage Properties (“Heritage Properties,” “we,” “us,” or “our”). By using the Site or agreeing to receive text messages from us, you agree to these Terms. If you do not agree, please do not use the Site or our text messaging program.

1. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date above. If you keep using the Site or our text messaging program after changes are posted, you accept the revised Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• use the Site in any way that violates any applicable federal, state, or local law;
• try to gain unauthorized access to the Site, its servers, or any connected systems;
• interfere with or disrupt how the Site works;
• use any robot, scraper, or other automated means to access or copy the Site’s content;
• submit false or misleading information through any form on the Site.

3. Intellectual Property

The content on the Site, including text, graphics, logos, images, and layout, belongs to Heritage Properties or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, distribute, or create derivative works from the Site’s content without our written permission.

4. Property Listings and Information

Property listings, rental rates, availability, and other information on the Site are provided for general information only and may change without notice. We try to keep information accurate, but we do not guarantee it is complete, current, or error-free. Nothing on the Site is an offer to rent or a binding commitment. A tenancy is created only by a signed lease agreement.

5. SMS / Text Messaging Terms

Program. Heritage Properties sends text messages to residents, applicants, property owners, and vendors/contractors we work with. Messages come from (940) 314-4224.

What we send. We send service messages about your lease, property, or work with us:

• maintenance requests and scheduling;
• work orders, invoices, and payment status;
• rent reminders and account notices;
• emergency and safety instructions;
• replies to messages you send us.

We do not send marketing or promotional text messages on this number.

How you opt in. You agree to receive text messages from us when you:

• sign our Tenant Lease Addendum (Section 6, Text Message and Electronic Notice Consent);
• sign our Independent Contractor Agreement (Section 11, Communications and Text Messages); or
• text us first.

Consent to receive text messages is not a condition of renting from us or doing business with us. You can always reach us by phone or email instead.

Message frequency. Message frequency varies based on your account activity and open requests.

Costs. Message and data rates may apply. Check your mobile plan for details.

Opting out. Reply STOP at any time to stop receiving text messages. You will get one confirmation message, and we will send no further texts unless you opt in again by replying START. Opting out of texts does not end your lease or agreement. We will still contact you by phone, email, or mail as your lease or agreement allows.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Privacy. We do not sell, rent, or share your mobile number or text messaging consent with third parties or affiliates for marketing purposes. See our Privacy Policy for how we collect, use, and protect your information.

6. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. These include, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Heritage Properties and its owners, brokers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Site or our text messaging program. This limitation applies even if we have been told such damages are possible. Nothing in these Terms limits any rights you have under your lease or under applicable law that cannot be waived.

8. Third-Party Links and Services

The Site may contain links to third-party websites or services, including our online resident portal and payment providers. We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Your use of them is at your own risk and subject to their own terms.

9. Fair Housing

Heritage Properties complies with the federal Fair Housing Act and the Texas Fair Housing Act. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, or disability.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site, or our text messaging program will be brought in the state courts located in Wise County, Texas.

11. Severability

If any part of these Terms is found unenforceable, the rest of the Terms remain in full force and effect.
